Purchase Contract

PURCHASE CONTRACT

This agreement is between SibFox (Seller), 848 Rainbow Blvd #1274, NV 89107, and

_______________________________________________________________________________________

(Buyer).

The agreement between the Seller and Buyer is as follows:

DESCRIPTION OF FOX

The fox sold pursuant to the terms of this agreement as follows:

Breed: Red Fox (Vulpes vulpes)

The Seller guarantees that the fox sold is the genuine domesticated fox from the farm in Novosibirsk, Russia (also referred to as “Belyaev’s experiment” or “silver domesticated fox”).

GENERAL

a) The Buyer agrees to allow the Seller the right of first refusal should the Buyer decide to sell, relinquish, or transfer the fox.

b) Should the Buyer choose to break any of the covenants of this Contract, the Contract will be considered null and void, and the Seller will have the right to repossess the fox with no cost to seller and no refund of monies to the Buyer.

c) The Buyer agrees that he/she is not acting as or in part of an agent in the purchase of this fox and that the Buyer will not sell this fox to any agent or pet store.

d) All monies mentioned in this Contract are in United States dollars.

e) This Contract applies to the original fox only and is nontransferable to a second party.

SELLER'S REPRESENTATIONS

a) The following representation and conditions apply to the aforementioned fox: The Seller guarantees that the fox is free of life-threatening diseases or disabilities (i.e., heart murmurs, parvovirus, etc.) for 72 hours after delivery to the Buyer.  A health certificate and pedigree will be provided upon purchase.

b) The Buyer has 72 hours to have the fox examined by a licensed veterinarian.  If, as a result of this examination, the veterinarian determines that the fox is not in good health, then the Buyer shall elect to keep the fox or return the fox to the Seller for a refund or replacement at the Seller’s discretion.  If the Buyer elects to return the fox, the Buyer shall, within 7 days after the date of the signing of this Contract, send to the Seller, by certified mail, a written veterinarian’s statement, stating that the fox was ill when examined.  Upon the receipt by the Seller of said statement, the Buyer shall be obligated to return the fox, the Seller shall be obligated to refund the purchase price of the fox or provide another fox at the Seller’s discretion, and further performance under this Contract shall be null and void.  All action taken to return the fox shall be done with the best interest of the fox in mind, including temperature at the time of shipment, non-stop flights, etc.  The Buyer shall be solely responsible for all costs and related expenses of returning the fox to the Seller.  Should the Buyer decide to keep the fox, he forfeits all claims and shall be solely responsible for any and all future veterinarian bills for the fox.

c) Ownership of the fox will be transferred to Buyer for the sale price of ($ ________).  It is to be paid as follows: 100% of amount as deposit on the execution of this agreement.

d) If delivery is requested by the Buyer, it shall be air freight and prepaid to a designated location.  The Seller will be responsible for cost of crate, cost of freight charges, and any and all charges and documentation required for shipping inside and outside the continental United States.

e) The Seller’s maximum responsibility is limited to the purchase of the fox.  Any subsequent expenditure is the sole responsibility of the Buyer.

f) The Breeder makes no guarantee regarding the loss of the fox because of accidental death, theft, sickness, etc., or any other loss beyond the Breeder's control, except as stated above.

g) The Buyer agrees to notify the Breeder of any health or temperament problems that develop in this fox during its life whether it pertains to guarantees or not (i.e. cancer, heart problems, etc.)

h) Shall the Buyer have any concerns with the fox that he wants to pursue legal action, the Seller should be informed and given 30 days to offer a solution before the case is filed in court.

i) All foxes sold by the Seller are neutered. The Buyer shall not claim to be a breeder of domesticated foxes.

 

MAINTENANCE

a) The Buyer agrees to maintain this fox in good health, provide routine preventative health care including, but not limited to, inoculation, and internal and external parasites.

b) The Buyer further agrees to provide proper exercise as indicated in order to maintain this fox at a proper weight and in good physical shape. A proper diet consists of top-quality puppy/dog food and supplements.

c) The Buyer agrees to NOT start SCHUTZHUND BITE/PROTECTION TRAINING of this fox.  The Buyer acknowledges that failure to meet the requirements of this section will result in the Buyer forfeiting all claims and shall be solely responsible for any and all future veterinarian bills for the fox.

TEMPERAMENT

a) The Seller recommends that the Buyer attend obedience classes for dogs with the fox and provide proper socialization opportunities for the fox.

b) The Seller shall not be held responsible for acts of the fox that are due to the Buyers negligence.

c) The Buyer agrees that this fox is NOT to be LEFT IN A BACKYARD or KENNEL ONLY.  This fox is sold with the understanding that it is to go to carefully selected parties and that the Buyer AVOWED that the fox would become a member of the family. (This is to assure proper development and maintenance of the temperament for which the animal was bred.)

d) Should the fox exhibit aggressive behavior which the Buyer deems intolerable and irreversible within 12 months after purchase (Bite/Protection work will void this section of the contract), evaluations of the fox be scheduled with three recognized veterinarians, one to be chosen by the Buyer, one to be chosen by the Seller, and one to be chosen jointly.  Should the fox be deemed overly aggressive by two of the chosen veterinarians, the Seller will arrange for the euthanasia of the fox or take it back  and provide the Buyer with a replacement fox as soon as such a fox is available to the Seller, or refund of 50% of the purchase price, the choice of which is at the Seller’s discretion.

Any other agreements are invalid unless stated in writing below.

By signing this agreement, the Buyer is stating that he/she has read and understands its contents.
